Elderly man settles injury claim* for €250,000

A grandfather and father of five who was caused to fall down a stairs in a well-known pub has settled his High Court personal injury* claim for €250,000.

The man sued the owners of the The Stag’s Head pub in Dublin arising from severe injuries he suffered as a result of the accident. The judge of the High Court, Ms Justice Mary Irvine, was told that the man suffered a severe brain injury from the fall and will require 24 hour care for the rest of his life.

The man claimed that the owners of the pub failed to provide a safe means of access to and from the toilets in the pub. He also claimed that they failed to give adequate warning of the dangers allegedly present in the stairwell. This was disputed by the Defendants who claimed that the man failed to descend the stairs in a safe manner, fell as a result of his own negligence and was the author of his own misfortune.

The court was told that the elderly man has no memory of the accident. CCTV footage taken from the pub showed the man taking the first step and then tumbling forward.

Ms Justice Mary Irvine in approving the settlement of €250,000 commented that the way the man’s five children had looked after him on a rota basis since his accident was quite humbling.
