Child awarded €14,000 in damages

A nine year old child has been awarded €14,000 in compensation as a result of a personal injury* claim against Burger King.

The girl, through her father sued Burger King Ltd, trading as OKR Group, with a registered address at Merrion Square, Dublin. She was scalded and scarred when a carton cup of hot tea was spilled on her left shoulder after a customer had bumped into her tray.

The girl was taken to the Emergency department of Children’s University Hospital, Temple Street, Dublin where she was diagnosed as having suffered a second degree scald. She was prescribed antibiotics and discharged the same day.

The Judge of the Circuit Court, Judge Matthew Deery, was told that the girl was left with a permanent half inch scar on her left shoulder. In an affidavit her father, said that since the accident, his daughter had become anxious when she was near a boiling kettle. The Judge was told that the defendant company made a settlement offer of €14,000, which was approved by Judge Deery.
