An elderly woman who was knocked down by a van at North Road, Finglas, Dublin, has had a settlement of €950,000 in damages approved by the High Court arising from an injuries claim*.
The High Court was told that the elderly lady was on the way to meet her daughter when the accident happened. The woman’s daughter sued, on behalf of her mother, the van driver and his employer for the severe personal injuries she had suffered together with the cost of her future care and expenses. The van driver was existing a commercial premises and was about to turn left when the accident occurred.
The woman suffered severe head injuries and remained in hospital for almost two months. The Judge of the High Court, Ms Justice Mary Irvine, was told that the woman had led an active life prior to the accident but that she would require 24 hour care for the rest of her life. Ms Justice Mary Irvine in approving the settlement said she considered contributory negligence would have been 25% if the case had gone to hearing.
