A 30 year old woman who broke her two front teeth after she dived into a shallow swimming pool and hit the bottom, has been awarded €35,000 in damages.

The woman took a personal injury claim* against a Dublin fitness club following the accident. The woman claimed that the pool was unsuitable for diving into and said that if a lifeguard had been present at the time of the accident, she could have been warned that diving was not allowed in the swimming pool.

Evidence given by a forensic engineer on behalf of the woman, said that the swimming pool didn’t have a deep end which was unusual and was about four feet in depth throughout its length.

Judge Jacqueline Linnane said that the depth of the pool was unsuitable for diving and that it was not adequately marked. Judge Linnane awarded the woman €35,000 in damages and said that the woman she was not guilty of contributory negligence.
